MILBOUR, N. Y. – A New York-based New York firm has agreed to pay $75 million to the U. S. Justice Department for the illegal importation of Viagra, the world’s biggest drug after the patent on its active ingredient in erectile dysfunction tablets. The money is expected to help the company to reclaim the patent from the U. government on erectile dysfunction drug Cialis.
The agreement is a big business for the New York-based firm, which had been looking at other opportunities to grow as a result of its patent litigation.
But Pfizer Inc.’s patent on Viagra expired in 2011 and now the company must file a new application for the patent for a new product. The new patent would have allowed the company to obtain the patent for the use of Viagra without any prior authorization.
Viagra, a drug for treating erectile dysfunction, is marketed by Eli Lilly & Co. and is produced by Bayer in dosages of 5mg and 25mg.
Viagra’s patent on Cialis expired in 2013 and the FDA has approved it for sale to treat erectile dysfunction, including the treatment of the problem in the United States.
The company is also looking at other ways to make Viagra available to patients.
“I believe the most important thing is to protect the life and health of the American people and not lose it,” said David P. Rosen, president of the New York-based drugmaker. “It’s a win-win.”
Viagra is made by Pfizer and Cialis is made by Eli Lilly and Co. Pfizer’s patent on the drug expired in 2011. It was approved for sale to treat erectile dysfunction in the United States in 2013.
Pfizer had said it was interested in creating a similar product, but the company has been negotiating with suppliers to make Viagra available to patients.
“We have a long history of successful deals in the pharmaceutical industry, and we are looking forward to helping the company to regain its patent protection in the United States,” P. G. Schulz, the company’s president, said in an e-mailed statement.
Pfizer said it has had a number of sales opportunities since its patent expired in 2011.

The company is also looking at other opportunities for the New York-based firm.
In November, the U. Food and Drug Administration announced that it had granted approval for a generic version of Viagra to be sold in the United States.
The new drug would be called Viagra and will be called Viagra-X. The FDA approved this generic version of Viagra in 2011 and the generic is expected to make it available to more patients in the United States.
Viagra is currently available only in New York and is expected to be available in pharmacies in several regions.
